Terms of Service

1. Agreement to terms

By accessing or using any website, application, or service operated by Dogy Technologies Pvt. Ltd. ("Dogy", "we", "us"), including dogy.co.in, client login areas, and our software products, you agree to these Terms of Service ("Terms"). If you do not agree, do not use our services.

If you enter into a separate written contract (e.g. development agreement, enterprise SLA), that contract prevails where it conflicts with these Terms for the covered services.

2. Our services

Dogy provides software development, digital products, subscriptions, hosting-related services, and client support, including but not limited to:

• Custom website and mobile application development
• AI solutions and digital marketing services
• SaaS and licensed products (e.g. Dogy ePaper, Dogy News, Dogy Express, imDoggy)
• Client dashboards, renewals, invoicing, and payment processing

We may modify, suspend, or discontinue features with reasonable notice where practicable. Beta or trial features are provided "as is" without warranty.

3. Accounts & eligibility

• You must be at least 18 years old and legally able to enter contracts in India.
• Registration information must be accurate, current, and complete.
• You are responsible for safeguarding login credentials and all activity under your account.
• Notify us immediately of unauthorised access at support@dogy.co.in.
• We may suspend or terminate accounts that violate these Terms or pose security or legal risk.

4. Acceptable use

You agree not to:

• Use our services for unlawful, fraudulent, or harmful purposes.
• Upload malware, scrape systems without permission, or attempt unauthorised access.
• Infringe intellectual property, privacy, or publicity rights of others.
• Send spam, harass users, or distribute illegal or offensive content via our platforms.
• Reverse engineer, resell, or sublicense our software except as expressly permitted in writing.
• Overload or disrupt our infrastructure (denial-of-service, excessive automated requests).

We may investigate violations and cooperate with law enforcement where required.

5. Intellectual property

Our property

All trademarks, logos, source code, designs, documentation, and content created by Dogy remain our property or our licensors', except as licensed to you.

Your content

You retain ownership of content you submit (text, images, business data). You grant us a limited licence to host, process, and display it solely to provide the services.

Custom development

Ownership of deliverables from custom projects follows the signed project agreement. Unless agreed otherwise in writing, upon full payment we may grant you a licence to use the delivered work for your business purposes.

6. Payments & subscriptions

Fees, billing cycles, and renewal terms are shown at checkout, in your client dashboard, or in your invoice. By paying, you authorise us and our payment partners to charge the stated amount.

• Subscriptions may auto-renew unless cancelled per your plan terms.
• Prices may change with notice before the next billing cycle.
• Late or failed payments may result in suspension of access.
• Refunds are governed by our Refund Policy.

7. Disclaimers

Except as expressly stated in a written agreement, our services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee uninterrupted, error-free, or fully secure operation. You are responsible for backups of your critical data where not included in your plan.

8. Limitation of liability

To the maximum extent permitted by Indian law, Dogy and its directors, employees, and partners shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.

Our total liability for any claim arising from these Terms or the services shall not exceed the amount you paid to us for the specific service giving rise to the claim in the three (3) months preceding the claim, or ₹10,000, whichever is higher, unless a higher limit is set in a signed contract.

9. Indemnity

You agree to indemnify and hold Dogy harmless from claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the services, violation of these Terms, or infringement of third-party rights through your content or conduct.

10. Termination

Either party may end the relationship as per your plan or contract. We may terminate or suspend access immediately for breach, non-payment, or legal requirement. Upon termination, your right to use the service ceases; provisions that by nature should survive (payment obligations, IP, liability limits, dispute resolution) will survive.

11. Governing law & disputes

These Terms are governed by the laws of India. Courts at Hyderabad / Khammam, Telangana shall have exclusive jurisdiction, subject to mandatory consumer protections where you qualify as a consumer under applicable law.

Before litigation, parties agree to attempt good-faith resolution by contacting support@dogy.co.in within 15 business days of the dispute arising.

12. General

• Entire agreement: These Terms, our Privacy Policy, Cookie Policy, and Refund Policy form the standard framework for online use.
• Severability: If any clause is invalid, the remainder stays in effect.
• No waiver: Failure to enforce a right is not a waiver of that right.
• Assignment: You may not assign these Terms without our consent; we may assign to an affiliate or successor.
